Terms and Conditions

1. Definitions

ENSIS Ltd (ENSIS): The Company, registered in England providing the financial management, on a not for profit basis, of the 2012 International Paleolimnology Symposium (IPS2012) in Glasgow, Scotland, on behalf of the International Paleolimnology Association (IPA).

International Paleolimnology Association (IPA): The international organisation of scientists dedicated to the understanding of lake history from the analysis of lake sediments. It is an unincorporated association with a constitution, a membership and a duly appointed committee (http://paleolim.org).

Delegate: An individual registered on the IPS2012 website making payment to attend IPS2012 including associated events such as excursions and the symposium dinner.

Fees: Payment made by a Delegate, or any third party on behalf of a Delegate, for attendance at the IPS2012 including associated events.

Service Provider: SagePay – ENSIS’ third party Service Provider.

2. Fees and Payment

2.1 All payments made through this online payment facility must be made in Pounds Sterling (£). Any currency conversion costs or other charges incurred in making the payment or in processing a refund shall be borne by the Delegate or the third party making payment, and shall not be deductible from the Fees due to ENSIS.

2.2 Once a payment has been verified and received by the Service Provider, the payment may not normally be cancelled. In certain circumstances the Delegate, or the third party making payment, may be entitled to a refund in accordance with Clause 3 below.

3. Refund of Fees

3.1 In the event that the Delegate wishes to cancel their booking then they shall be refunded the full amount less 20% if cancellation takes place before 23rd June 2012, the full amount less 50% if cancellation takes place between 23rd June 2012 and 3rd August. If cancellation takes place after 3rd August or no show then no refund will be made.

3.2 In the event that any payment of Fees is to be refunded (either fully or in part) ENSIS will endeavour to make the refund to the bank account from which the refundable payment was made after the Delegate, or third party making payment, has completed a signed refund request form.

4. Security

4.1 ENSIS will not store any card data. All payment details which are entered on the Service Provider’s site are sent via a secure connection when the Delegate, or third party making payment, enters them. Communications to and from the Service Provider’s site are encrypted.

4.2 ENSIS shall not be liable for any failure by the Delegate or third party making payment of Fees to properly protect data from being seen on their screen by other persons or otherwise obtained by such other persons, during the online payment process or in respect of any omission to provide accurate information in the course of the online payment process.

5. Service Provider

5.1 Online payments of Fees can be made by credit or debit card. These payments are not collected by ENSIS directly but by the Service Provider. On accepting these terms and conditions the Delegate, or third party making payment, will be redirected to a website which is maintained and administered by the Service Provider.

5.2 The Delegate, or third party making payment, will then be asked to submit appropriate personal and financial information to the Service Provider so that the online payment process can be offered.

5.3 Once payment is received by the Service Provider in cleared funds, in accordance with clause 5.2 above, the Service Provider will contact ENSIS to confirm the details of the successful payment made by the Delegate, or third party making payment. The Service Provider will confirm the details of the successful payment to the Delegate, or third party making payment via the email address supplied. On receipt of payment confirmation ENSIS will confirm to the Delegate that the payment has been received and accepted via the IPS2012 website. In the event that the Delegate does not receive confirmation from the Service Provider within 14 days of making the payment it is the responsibility of the Delegate to check with ENSIS that the payment has been received and accepted.

5.4 The Delegate shall remain responsible for the Fees until such time as the confirmation referred to in clause 5.3 above is received from ENSIS.

6. Data Protection

In this clause the term “Personal Data” is as defined in the Data Protection Act 1998 (DPA).

6.1 ENSIS will collect Personal Data relating to the Delegate, or third party making payment, including name and address, in accordance with its Data Protection Policy. The Service Provider will collect bank details required to facilitate online payment.

6.2 By agreeing to be bound by these terms and conditions the Delegate, (and any third party making payment), accepts and consents to his/her Personal Data, as detailed in clause 6.1, being provided to the Service Provider for sole purpose of the Service Provider offering and administering the online payment facility to the Delegate, or third party making payment.

6.3 It is the responsibility of the Delegate, or third party making payment, to ensure that all Personal Data provided to or held by ENSIS and/or provided to the Service Provider is clear and accurate. ENSIS will not be responsible for any losses suffered by the Delegate, or third party making payment, as a result of inaccurate information being provided to ENSIS or the Service Provider.

6.4 ENSIS may use the personal information provided to it to contact the Delegate, or third party making payment, to clarify or resolve any issues that arise in connection with any online payment made in respect of the Fees.

7. Governing Law and Jurisdiction

The formation, existence, construction, performance, validity and all aspects whatsoever of these terms and conditions or of any individual term or condition herein will be governed by the law of England and Wales. The courts of England and Wales will have non-exclusive jurisdiction to settle any disputes which may arise out of or in connection with these terms and conditions. The parties irrevocably agree to submit to that jurisdiction.
